Abstract

The article discusses the theory of human rights from the rescue of evolutionary principles and historical development advocated by Marshall and Bobbio, respectively. It proposes a reflection on the limits of realization of human rights , with emphasis on social rights, with reference to the Marxist critique of law. It presents social policies as operational mechanisms of social rights , discussing them as state instruments whose objectives are focused on the reproduction of the labor force, occupied and surplus, confronting the design and places the struggle for social policies as an end in yourself.

Assistente Social, Doutora em Serviço Social e Política Social pela PUC/SP, Professora Associada da Universidade Estadual de Londrina. Discute e pesquisa áreas em que o Serviço Social se relaciona com a aplicação e execução da justiça como o Sistema Penitenciários, Medidas Socioeducativas, Penas alternativas, Justiça Restaurativa, e práticas profissionais no Judiciário, Ministério Público.
