A PROPRIEDADE INTELECTUAL COMO FERRAMENTA PARA DIFICULTAR O REPARO DE EQUIPAMENTOS ELETROELETRÔNICOS

Abstract

This article addresses the movement that pleads for the regulation of the right to repair and its consequences on the means of production of electrical and electronic equipment. Based on this premise, it becomes necessary to demonstrate the practices used by the manufacturers of this equipment to hinder or prevent its repair. Therefore, it was possible to understand that the legal protection of intellectual property is widely used by manufacturers in order to guarantee their profits, and not to encourage research and technological innovation, which results in serious consequences for consumer rights, the environment, the free market and society as a whole. That said, the analytical method is used, exercising a deductive reasoning based on the conclusions verified in the specialized bibliography. The analysis allowed us to conclude that, in fact, the protection of intellectual property has been used by manufacturers to maintain vested interests, and it is necessary that any regulation of the right to repair also determines the flexibility of copyright in favor of the consumers themselves.
