State, democracy and subject of law: toward a critique of contemporary politics

In this article, I refer to the relevance of Nietzsche's contribution to the reflection and debate on key issues in political philosophy and contemporary law, such as sovereignty, citizenship, human rights, justice, state and democracy. In this context, this paper aims to show that aconnection between Nietzsche and Agamben explains the project of overcoming the form-right and allows to interpret the political inequality with the help of the concept of bando (bunch), rather than resorting to the paradigm of the social contract.
