Abstract

This text analyses the recent decision of the Federal Constitutional Court of Germany that declared the unconstitutionality of the amount paid to asylum seekers (Asylbewerber). The decision reaffirmed and consolidated some views of the Court on the living wage (Existenzminimum). Furthermore, instead of simply declaring the unconstitutional act void, the Court established a transition rule (Übergangsregelung), which involved assigning prospective and retroactive effects to the ruling.
