The transplantation of context analysis for the criminal law investigation in Colombia's domestic law

Abstract

In contemporary legal systems, the transplantation of legal concepts has become a trend. This trend is especially evident in Latin America, where the law from the highest legal institutions of many countries is being introduced into domestic law. Including concepts and methodological structures taken from the Inter-American Court of Human Rights. One of these methodologies is context analysis. This article studies the main problems that the transplantation of this methodology has for criminal investigation, by looking from international law and Colombia’s domestic law.
