The Legal Discourse for Name and Gender Recognition
Brief Considerations on Provision No. 73/2018 of the National Council of Justice

This article intends to present a critical analysis of the legal discourse that involves the regulation of the administrative procedure for changing the name and gender of the transgender subject at the Civil Registry of Natural Persons (RCPN). Instead of regulating the issue in order to ensure the dignity of the holders of the rights in question, the National Council of Justice (CNJ) chose to maintain terms and methods resulting from the dominant heteronormative discourse, which reinforce the discrimination suffered.
