JUDICIALIZATION OF THE RIGHT TO HEALTH:
AN ANALYSIS OF THE JUDICIAL DEMANDS IN ACOPIARA/CE FROM 2017 TO 2019

The right to health is one of the main guarantees enshrined in the Federal Constitution of 1988. Not addressed in past constitutional charters or superficially addressed in others, this right is intrinsically linked to the principle of human dignity, a sacred symbol of the Democratic State of Law. Based on this premise and on the increase in lawsuits that have as their object the realization of this constitutionally foreseen guarantee, the present study aims to analyze the phenomenon of the judicialization of health in its main nuances and to verify the legal demands on health that were processed in the District of Acopiara/CE in the period from 2017 to 2019. The research is descriptive, based on the quanti-qualitative literary approach, having as a structural element the analysis of judicial processes consulted on the website of the Court of Justice of the State of Ceará, with the formulation of its own script and notes on the sociodemographic profile of the claimants, the object of the claim and the outcome of the lawsuits. Among the conclusions presented, it was inferred that the phenomenon of the judicialization of health has different consequences within the scope of the three Powers, such as reflections on the financial and budgetary administration of the State. Within the scope of the District of Acopiara-CE, it was found that more than half of the actions aimed at the supply of medicines, followed by the performance of exams and appointment of surgeries.
