LAW N. 13.964/2019 AND THE REACH OF RES JUDICATA IN THE DECISION TO ARCHIVE THE POLICE INVESTIGATION

This article seeks to investigate the relationship, within the scope of criminal procedure, between the institution of res judicata and the decisions to archive the police investigation, studying, in particular, the main changes promoted by the Anticrime Package. At first, it is essential to make some notes on res judicata in the criminal procedure, also discussing the procedure for archiving the police investigation, before and after Law n. 13.964/2019. Based on bibliographic review and legislative and jurisprudential analysis, this research addresses the closure of the investigation in the light of procedural legislation, also based on doctrinal considerations. At the end, it is necessary to recognize that the new procedure instituted by the Anticrime Package, whose effectiveness is suspended by order of the Federal Supreme Court, has removed the res judicata that covered the decisions to archive the police investigation.
