EVGENY PASHUKANIS’ MARXIST JURISPRUDENCE
METHODOLOGICAL PREMISES, CENTRAL CONCEPTS AND A CRITIQUE STEMMING FROM HANS KELSEN

Through a bibliographic research, this paper aims to introduce the reader to Evgeny Pashukanis’ Marxist jurisprudence, pointing out to the conditioned character of the criticism he performs on the fundamental legal concepts. Based on his main work, “General Theory of Law and Marxism”, it begins by stating his main goals and the methodological premises he adopts. The following section will be dedicated to the core of his thought: the analysis of the legal form through the fundamental concept of legal relation, which stems from the emergent notion of legal personality. Thereafter, Pashukanis’ conceptions on some of the main topics of Jurisprudence will be addressed. Finally, a methodological critic on the soviet legal theorist’s thought will be sketched. It will be done by recurring to some of Hans Kelsen’s early stage work on materialist conceptions on Jurisprudence, which points out to the conditioning effect exerted by two of the premises adopted by Pashukanis on the outcome of his work. The paper concludes, alongside with Kelsen, that, in order to sustain his main thesis, he ends up ignoring the critic on the dualism on traditional Jurisprudence developt by the Pure Theory of Law.
