OAB and Responsive Regulation

[Purpose] The article aims to investigate whether there is conformity between the disciplinary action of the Ordem dos Advogados do Brasil (Brazilian Bar Association) and the Responsive Regulation Theory proposed by Ayres and Braithwaite.
[Methodology/approach/design] The article aims to determine whether the existing procedure for disciplinary punishments within the Bar Association of Brazil meets the commands of Ayres and Braithwaite's responsive regulation theory, also using the statistical reports released by the OAB Section.
[Findings] Although the high number of regulators and the lack of an OAB operational structure to deal with infringing practices by lawyers and law firms are limiting factors to regulatory control, the greater diffusion of the theory of responsive regulation can contribute to regulatory changes capable of providing a responsive environment within the scope of the OAB.
[Practical implications] The article seeks to stimulate discussions about the possibilities of changing the punitive procedure within the scope of professional councils, notably the OAB, to improve disciplinary regulation and mitigate the social damage caused by acts of transgressive lawyers.
[Originality/value] The article fills a gap in the study of regulation, which may represent a change in the regulatory approach of professional class councils.
