DISCURSIVE AND SOCIAL ANALYSIS OF “JURIDIQUÊS”

In the everyday practice of Law in Brazil, there is an excessive use of technical-legal language in an outdated and convoluted manner, which many authors call “juridiquês”. This work aimed to present the conceptual-analytical scope of the “juridiquês” theme and discuss the possible impacts of its use on access do Justice. Exploratory, retrospective and document-based research was carried out, with a bibliographic review of articles published in Portuguese on the subject without temporal delimitation. This study allowed an exploration of the constructive characteristics of “juridiquês” as a language instrument, present the main theories of “discourse analysis” that support its discursive power and discuss the social impacts of its use. In conclusion, it pointed out the “juridiquês” as an obstacle to the democratization of Law by creating two important abysses in the legal landscape: of information and access. At the end, it presents movements and proposals for solutions to encourage the use of language as an exercise of full citizenship, so that the Law can fulfill its fundamental role of democratically serving everyone.
