THE PROTECTION OF LABOR LAW TO SURROGACY AS A FUNDAMENTAL RIGHT

The controversy about the possible application of the labor law, with its feature as a fundamental right, to the surrogacy represents a hypothesis not yet addressed in Brazilian law. Due to the scarcity of such reflections, Brazil currently applies Resolution nº 2.168/2017 of the Federal Council of Medicine, which only allows the altruistic surrogacy. Therefore, the objective of this article is to reflect on the legality of the prohibition of paid surrogacy and its consequences. The method used is qualitative since the research has an exploratory feature in order to bring existing contradictions to the surface. The results achieved demonstrate that the prohibition of the paid surrogacy does not necessarily prevent its existence. In addition, the prohibition on remuneration is based on moral issues that, by themselves, cannot prohibit the practice, which is why it is the protection of the labor law for surrogates.
