Through the doctrinal, legal, statistical, jurisprudential approach, this research will deal with the regulation of the term “placing the elderly in a substitute family” by a new institute to be added to family law: the Senexão. The work will aim to analyze the viability of the Senexão institute as an alternative measure of support for elderly orphans, through the deductive approach method and the comparative procedure. This article will reach, conclusively, the viability of the new institute in spite of the legal and conceptual inadequacy of the general terms of the institute of the adoption of children and adolescents in face of the negligent adequacy of the adoption of the elderly, prioritizing throughout the analysis threshold comparative the defensive principle of the right of the elderly guaranteed by the specific law and the Magna Carta.
