Comparação e interpretação na antropologia jurídica

Resumo

O problema da comparação na Antropologia Jurídica está intimamente relacionado com as questões relativas à interpretação e/ou compreensão do universo jurídico/legal nas sociedades não ocidentais, cuja discussão tem polarizado o debate entre os defensores das abordagens normativista e processualista}. O esforço de compreensão de situações ou de processos de resolução de disputas requer uma análise/avaliação de interpretações alternativas do problema em pauta e, portanto, um envolvimento inevitável com a comparação. Em outro lugar (Cardoso de Oliveira 1989: Parte 2), sugeri que para se dar maior densidade à compreensão destes processos deve-se analisar as respectivas alternativas interpretativas (e/ou versões dos casos) a partir de uma preocupação com questões de equidade, as quais são constitutivas do universo jurídico/legal enquanto tal. Neste sentido, o esforço de comparação entre diferentes sistemas jurídicos deveria se guiar pelos mesmos princípios. É .verdade que a tarefa hermenêutica da "tradução", para utilizar um termo difundido por Geertz, pode ter que ser ampliada aqui para dar conta (e tornar mutuamente inteligível) das particularidades de línguas estrangeiras, da especificidade de culturas "exóticas" e da contextualização histórica de diferentes tradições. Contudo, isso não quer dizer que tal abordagem tenha que ser menos crítica como condição para desvendar novos significados e promover interpretações reveladoras.
