SOSTENIBILIDAD Y DERECHO INTERNACIONAL PRIVADO

El derecho internacional privado tiene un papel importante, aunque hasta ahora ha sido poco valorado, en las respuestas jurídicas a los mayores desafíos que enfrenta nuestro planeta. Este artículo se centra en el papel tradicional de la disciplina, consistente en coordinar la interacción entre distintos regímenes de derecho privado, así como en sus funciones facilitadoras y reguladoras. En una dicotomía paralela a la tensión entre desarrollo y sostenibilidad, el derecho internacional privado propicia la libre circulación a través de las fronteras al tiempo que regula conductas perjudiciales, tanto para las partes vulnerables como para el ambiente. Este artículo aborda cuestiones estructurales generales y plantea dos ejemplos concretos del papel del derecho internacional privado en relación con la sostenibilidad: los litigios transnacionales sobre cambio climático y la gobernanza de las cadenas de suministro.
