Smart Regulation and regulatory governance of the National Fund for Scientific and Technological Development

Resumen

[Purpose] The National Fund for Scientific and Technological Development is an important public source of funding to support institutions in the sector. Its resources are managed by a federal public company, within a legal-normative framework that constitutes the Legal Framework for Science, Technology and Innovation. The main objective of this research is to analyze aspects of the Smart Regulation Theory applied to the regulation instruments of this Fund.

[Methodology/approach/design] The methodology will consist of verifying the applicability of the main principles and recommendations of Smart Regulation to the context of the instruments available to regulate the resources of the National Fund for Scientific and Technological Development, considering its legal and administrative framework.

[Findings] The conclusions indicate that the regulatory framework that governs the Fund is successful in relation to the interfaces between public and private law regimes, with the possibility of adapting it to the needs of the sector to transfer resources to the projects covered. The administrative and legal structure of this policy can be better developed in relation to the rules established for its operation, observing the premises of Smart Regulation, as there are instruments available to apply the principles of this theory.
