Risk-based Artificial Intelligence Regulation and its responsiveness

Resumen

[Purpose] To examine the responsiveness of a risk-based artificial intelligence (AI) regulation, such as the European proposal.

[Methodology/approach/design] Part 1 examines how technologies are regulated, especially, AI systems. Part 2 investigates how the European proposal is structured. Part 3 analyses the European proposal under the Really Responsive Regulation framework.

Findings – The findings shall point out whether the European proposal is responsive to the behaviors of the regulatees, to the institutional environment, to the regulatory logics, to its own performance and to change.

[Practical implications] The adoption of a responsive regulatory framework may reduce AI risks, promote its use on socially beneficial outcomes, facilitate compliance to and enforcement of the applicable rules.

[Originality/value] The risk-based Proposal for a Regulation of the European Parliament and of the Council laying down harmonized rules on artificial intelligence tends to influence the adoption of a risk-based approach by other countries, such as Brazil. Understanding the responsiveness of the proposed risk-based regulation may contribute to Brazilian legislative debates on AI regulation, taken into account the peculiarities of our national juridical system and of the particularities of the artificial intelligence field.
