Resumen

Purpose ”“ In Brazil, administrative lawyers have only recently taken notice of the importance to study law and public policy as closely interconnected subjects. In this paper, I will present Lasswell and McDougal’s policy-oriented approach, which is largely neglected by mainstream legal scholarship in Brazil.

Methodology/approach/design ”“ Narrative review of Lasswell’s and McDougal’s writings.

Findings ”“ The policy-oriented approach is a useful mindset/heuristic for making sense of many legal problems currently being faced in Brazil.

Practical implications ”“ This paper offers proposals on legal education, jurisprudence and judicial activism in Brazil.

Originality/value ”“ In spite of being well known in small academic circles in Brazil ”“ such as international lawyers linked to the New Haven School ”“, Lasswell and McDougal’s policy-oriented approach is still largely ignored by administrative lawyers, legal philosophers and specialists in legal education.
