Purpose ”“ To discuss the negotiated allocation of water as appropriate for a responsive regulation, instead of the usual command-and-control, approach, either through users’ networks, or through a keen Regulatory State process responsive to the regulatees’ behavior.
Methodology/approach/design ”“ The theory of responsive regulation was used to test the Brazilian model of negotiated allocation of water by envisioning an enforcement pyramid with stronger participation of players in Brazil of the National System of Water Resources Management (SINGREH), such as the Watershed Committee and the Federal and States Water Resources Commissions.
Findings ”“ Places in which water scarcity is common, such as the Brazilian Northeast, responsive regulation may help build a regulatory strategy attuned to mediating disputes on water usage and reinforce auto-regulation.
Originality/value ”“ This paper addresses, for the first time, how responsive regulation could be applied to water management processes in Brazil, as an alternative to the command-and-control approach.
