Responsive Regulation in the Water Sector: Improvement Proposals for the Regulatory Responsive Design in Brazil

Purpose ”“ To present aspects of responsive regulation of the Brazilian water sector and propose improvements in the regulatory governance of the sector.
Methodology/approach/design ”“ The theory proposed by Ayres and Braithwaite (1992), which incorporates a method of grading regulation between restorative justice, punitive justice and incapacitative justice, and the Australian regulatory model.
Findings ”“ To stimulate improvements in voluntary compliance and to consider the water sector as a whole, including as competences of ANA the role of supervisor of regulation of basic sanitation and manager of the SNIS.
Practical implications ”“ To improve the responsive regulatory design of Brazilian water sector and the regulatory governance of the sector.
Originality/value ”“ The present research indicates a lack of participation of the society in policies of basic sanitation and water resources and a fragmented water sector, which results in the need to improve the regulatory governance of the sector.
