Regulation of Brazil’s Civil Aviation: Enforcement and Legality

Purpose ”“ The article aims to propose a reflection on the legal possibility of replacing the application of the sanctions prescribed in the Brazilian Aeronautical Code (CBA) - especially in its article 289 - by alternative measures,
in case of verification of the occurrence of the infractions prescribed therein, allowing a regulatory enforcement that better reflects the administrative efficiency.
Methodology/approach/design ”“ The notion of efficient regulatory application is part of the economic analysis of crime undertaken by authors such as Gary Becker and George J. Stigler, analyzed by Michel Foucault, and the image, proposed by this philosopher, of a new, distanced right of a conception of law essentially linked to the principle of sovereignty and to the application of relations of domination.
Findings ”“ It was concluded that there is a possibility of temperament in the application of the penalties provided in the article 289, based on the adoption of a notion of regulatory application that best reflects the administrative efficiency, motivated by a hermeneutic based on constitutional principles, which provide a teleological criterion of administrative performance in order to optimize the reach of the public interest..
Practical implications ”“ To reflect on a possible juridicity, based on constitutional principles and the theoretical framework mentioned above, of the graduation of enforcement in the inspection and sanctioning policy of the National Civil Aviation Agency (ANAC), through the establishment of alternative measures, rather than the direct application of penalties in case of infractions.
Originality / relevance of the text ”“ The text intends, in general lines, to contribute to an analysis of the legality of the optimization of the execution when obstructed by the strict legality. The practical pertinence lies especially in the proper interpretation of legal provisions such as article 291 of the CBA, which provides, as a necessary consequence of the infractions, the application of sanctions, preventing, in principle, the adoption of a policy of tolerance that allows for prior mechanisms of collaboration and prevention.
