O presente artigo tem como objetivo analisar de que modo o instituto jurídico do usufruto das terras indígenas tem sido utilizado pelo Poder Judiciário como forma de efetivação do direito à autodeterminação interna dos povos indígenas. A leitura das decisões do Supremo Tribunal Federal sobre a ótica do usufruto indígena, principalmente, pode oferecer uma importante reflexão sobre as concepções e as práticas do Estado brasileiro no que concerne ao reconhecimento dos povos indígenas enquanto categoria identitária nacional e no tocante à perpetuação da tutela orfanológica dos índios durante o Século XXI.
