Abstract

The purpose of this article is to analyze the solo paragraph of article 611-B of CLT, included by Brazilian labor reform, taking into account the principle of non-regression. This study seeks to discuss the setbacks brought by this legal prevision, which has the scope of dissociating working time rules and rest breaks at work from health and safety standards of workers, in order to promote the reduction of the civilizational level reached by them. Thus, it is demonstrated the incompatibility of the referred norm towards the Constitution of the Federative Republic of Brazil, once it violates social rights acquired by workers and undermines the principle of non- regression.
