Compliance: a (rara) aplicação de instrumentos internacionais de proteção a direitos humanos pelos tribunais intermediários no Brasil

A consolidação democrática brasileira implicou a ratificação de tratados de direitos humanos, ao mesmo tempo em que a Constituição e as legislações incorporam o debate internacional. No entanto, perduram no Brasil constantes violações. Esta pesquisa tem por objeto a atuação do Judiciário em matéria de direitos humanos, investigando o teor das decisões e os usos de instrumentos internacionais nos tribunais estaduais e federais de três regiões brasileiras. Tendo como referencial teórico os debates sobre o compliance, investiga-se: a produção legislativa pós-Constituição Federal de 1988 teria resultado em uma quase total conformidade com os instrumentos internacionais, tornando inócuo seu uso? Haveria uma reprodução, por parte dos tribunais intermediários, de teses e entendimentos dos tribunais superiores, responsável pela pouca variedade de matérias encontradas?

Abstract

Brazilian democratic consolidation has entailed the ratification of human rights treaties, at the same time as the Constitution and legislation incorporate the international debate. Nevertheless, there are constant violations in Brazil. The purpose of this research is to investigate the content of decisions and the use of international instruments in the state and federal courts of three Brazilian regions. As the theoretical references, we discuss the concept of compliance. Our research questions are: the legislative production after the Federal Constitution of 1988 would have resulted in an almost complete conformity with the international instruments, rendering innocuous its use? Would there be a reproduction, by the intermediary courts, of theses and understandings of the superior courts, responsible for the little variety of matters found?
